Terms & Conditions
1. Introduction
Welcome to Arriba Physiotherapy, your trusted source for mobility and assistive products. These Terms and Conditions (the "Terms") are designed to clarify your rights and responsibilities when using our website, including browsing, purchasing products, and accessing information or services. By accessing our website, you agree to comply with these Terms. If you do not agree, please refrain from using our site.
2. Products
We offer a wide range of health and wellness products, including but not limited to mobility aids (such as wheelchairs, commodes, and rollators), assistive devices, orthopedic supports, compression garments, and therapeutic care products such as pain relief creams, heat or cold therapy items, and topical gels.
3. Orders and Payment
When you place an order, you are making an offer to purchase a product. All orders are subject to acceptance by us, and we will confirm this through an order confirmation email. Payment must be completed in full before the order is dispatched. We accept a variety of payment methods, including major credit cards and secure online payment services. For your protection, we utilise encryption technology to safely process your payment details.
We reserve the right to cancel any order for any reason, including but not limited to errors in pricing or availability. If your order is cancelled, you will receive a full refund.
4. Delivery
We strive to dispatch orders promptly and provide a delivery timeframe estimate at checkout. Please note that delivery times may vary based on your location and may be affected by external factors such as weather or carrier delays. While we will keep you informed of any unforeseen delays, we are not liable for any loss resulting from delivery delays outside our control. If you have not received your order within the estimated timeframe, please contact our customer service team for assistance.
Risk of loss or damage to the goods passes to you upon delivery. Please inspect your order upon arrival and notify us of any issues immediately.
5. Warranty
All products sold by Arriba Physiotherapy come with a warranty that adheres to Australian Consumer Law. This warranty guarantees that the products are free of defects in materials and workmanship at the time of delivery. The warranty does not cover damage resulting from misuse, neglect, normal wear and tear, or failure to follow product instructions. The specific warranty period for each product varies—please check individual product descriptions for detailed warranty information.
This warranty operates in addition to any rights you may have under the Australian Consumer Law, which cannot be excluded or limited.
Third-Party Products: Products sourced from third-party manufacturers are subject to the warranty and return conditions provided by the original manufacturer. Arriba Physiotherapy facilitates support but does not guarantee third-party product outcomes.
6. Refunds and Returns
We value your satisfaction and offer the following refund and return policies:
6.1 Change of Mind:
If you change your mind about a purchase, you may return the product within 30 days of delivery for a full refund or exchange, provided it is unused, in its original packaging, and accompanied by proof of purchase. To initiate this process, please contact us to arrange for the return.
Please note that return shipping costs for change-of-mind returns are the responsibility of the customer, unless otherwise agreed.
6.2 Defective Products:
If you receive a defective product, it is imperative that you contact us within the warranty period to report the issue. We will assess the defect and provide options for repair, replacement, or a full refund. We may request evidence of the defect (e.g., photos or a detailed description) to expedite the process.
Please note: For branded third-party products, the return process may involve coordination with the original manufacturer. Processing times may vary accordingly.
6.3 Return Process:
To return a product, please reach out to our customer service team at products@arribaphysio.com.au. They will guide you through the return process and provide you with a return authorisation. Please ensure that returned items are securely packaged to prevent damage during transit.
Refunds will be processed within 7–10 business days after we receive and inspect the returned item.
7. Consumer Rights
This section does not negate your rights under the Australian Consumer Law, which provides protections for consumers beyond what is stated here. If a product fails to meet acceptable quality or is not fit for its intended purpose, you are entitled to a remedy. In circumstances beyond our control, we strive to comply with your rights under consumer guarantees.
Nothing in these Terms and Conditions excludes, restricts, or modifies any rights, guarantees or remedies you may have under the Australian Consumer Law.
8. Limitation of Liability
To the extent permitted by law, and subject to your rights under the Australian Consumer Law, Arriba Physiotherapy will not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use our products or website. This includes damages for loss of profits, goodwill, or any other intangible loss. Our liability will be limited to the purchase price of the product in question.
Arriba Physiotherapy is not liable for injuries, damages, or complications arising from improper use, application, or modification of any product, including but not limited to third-party brands. Always follow manufacturer instructions and consult a health professional before use.
9. Medical Disclaimer
Products such as braces, supports, or therapeutic garments sold by Arriba Physiotherapy, including those from third-party brands, are not intended to diagnose, treat, cure, or prevent any medical condition. Always consult with a healthcare professional prior to use, especially for conditions requiring clinical intervention.
